Senator Joel Anderson has introduced legislation that would require the state to allow net operating loss carryovers for victims of investment fraud as well as other features that would be of great benefit to those who are victims. It is very difficult to get any legislation passed that would “increase” the deficit, even when it comes to money that is not the states money, or derived from a crime. This bill has gone to committee. It is critical that the State Legislators hear from you NOW! As someone who has been financially victimized by the fraud committed by Bernie Madoff I am supportive of Senate Bill 157.
To face a tax liability in addition to the investment loss resulting from Madoff’s fraud is simply unfair. The federal government has already recognized this injustice and addressed it by providing a net operating loss carryback for those citizens affected, and California should as well.
